In any event, a person of a specific nationality (or perception of a specific nationality) is in a protected class in some hate crime enhancements. Let's say the flag being burnt was flown on a flagpole outside an individual's house who also had a Stand With Israel lawn sign. The protestor objected to Biden's pro-Israel stance in the war against Hamas. If the victim's flag is burned as part of a campaign of harrassment, then yes, it can be argued that he's been subject to a hate crime because he refuses to question his own government's foreign relations. I can see a hate crime enhancement for that although it might be difficult to prove unless the criminal said something along the lines that he denounces the victim for not rejecting his country.
