He should, but he doesn't. He believes - under the current administration - that onus probandi is on the defendant. With regards to this administration and their cult of followers, it's now "guilty until proven innocent", with the caveat that they'll be shipped out of the country before they have a chance to prove it. Once a democrat is back in the oval office, he'll change his opinion and accuse them of gestapo tactics.
