Sure, because it is H that has the code that gets stuck or not, so blame 
goes to the one that had the option to change things.

If D gets in the infinte loop from H returning 1, then D is to blame for 
the infinite loop.

If H, despite being under the requirement to answer in finte time, 
doesn't do so, then H is to blame for D not halting.
