I likely would have voted to acquit if I were on the jury, though, considering that I'm a regular subway rider and have seen plenty of possibly dangerous crazy people. I haven't had my life directly threatened, though. Just lucky. I am NOT sympathetic to the idea that someone who makes unprovoked threats has a right to live. That doesn't mean that killing him is the only option to prevent harm to those he's threatened. What if he'd been shot after making threats while advancing on one of the passengers? Would there have been alternate way to restrain him? Are the police in position to second guess?
