Use of a prior title may be challenged on the basis of trademark
infringement but never on the basis of copyright infringement.

The current Matlock tv series is produced on some sort of licensing or
other contractual basis, even though none of the copyright material of
the original show has been used. It's absurd that they would pay a
licensing fee but there is no infringement to allege.
