La règle est contenue dans l'article L 113-2 du Code de la voirie 
routière et surtout dans une réponse ministérielle posée par un 
sénateur le 14 mars 1991. Il en ressort que le droit pose comme 
principe que le bénéficiaire est tenu de prendre à sa charge les frais 
de création des ouvrages et de leur entretien.
