United States. Dwayne Barrett was convicted under the Hobbes Act 18 U.S.C. Sec. 924, an act which allows there to be federal jurisdiction to prosecute a robbery. He was convicted under two different provisions of the statute, section 924(c) aiding the use of a gun, and section 924(j), aiding the use of a gun used in homicide. He doesn't want to be sentenced under both provisions, making a double jeopardy argument.
